The Trinko mobile game (the "Game") is operated by Dryhola Mark, an individual entrepreneur (FOP) registered in Ukraine ("we", "us", "our"). You can reach us at mdgametechnology@gmail.com.
These Terms of Service and End User License Agreement (the "Terms") are a binding agreement between you and us. When you first launch the Game, we show you these Terms and our Privacy Policy and ask you to accept them. If you do not accept, you cannot play the Game. By tapping "Accept", downloading, or otherwise using the Game, you agree to be bound by these Terms.
If we make material changes to these Terms, we will ask you to accept the new version the next time you launch the Game.
You must be at least 13 years old (or 16 in the European Economic Area and the United Kingdom) to use the Game. If you are a minor under the law of your country, you may use the Game only with the consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Game, including any purchases.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the Game on a device you own or control, for your own private, non-commercial entertainment. The Game is licensed to you, not sold.

The Game does not use accounts, logins, or passwords. Your level progress, coins, lives, power-ups, and settings are stored on your device only. This has consequences you should understand before you buy anything:
We may add optional cloud saving in a future version. Until then, the rules above apply.
The Game contains virtual currency ("Coins") and virtual items such as power-ups and extra lives (together, "Virtual Items"). Virtual Items are a limited license to use digital content inside the Game. They:
Your license to Virtual Items ends when your license to the Game ends.
The Game offers optional in-app purchases: packs of Coins, a starter pack, a power-up pack, and an option that removes interstitial ads. All purchases are processed by Apple, not by us, and are subject to its terms. Prices are shown before you confirm.
All purchases are final. Except where required by law, we do not offer refunds for Virtual Items, including for items lost through uninstalling the Game or for content you did not use. Refund requests are handled by the app store you purchased from, under its own policy.
If you are a consumer in the European Union or the United Kingdom, you have a statutory right of withdrawal for digital content, which you lose once delivery has begun with your express consent. Nothing in these Terms limits your mandatory statutory consumer rights.
The Game is supported by advertising. Optional rewarded video ads grant in-game rewards for watching; watching one is always your choice, and declining never blocks progress. Interstitial ads are shown between levels. The Game does not show banner ads. We offer a paid option that removes interstitial ads; it does not remove rewarded ads, which you choose to watch. How advertising data is handled is described in the Privacy Policy.
You agree not to use the Game to break the law, to interfere with its normal operation or the servers of our service providers, to attempt to gain unauthorized access to any system, or to exploit bugs for unfair advantage. We may update, change, suspend, or discontinue the Game or any of its features at any time, including balance changes, prices, and reward amounts. We may stop supporting older versions or older devices. We do not guarantee that the Game will always be available or error-free.
The Game and everything in it — code, artwork, 3D models, animation, music, sound, and the name "Trinko" — is owned by us or by our licensors and is protected by copyright and other intellectual property laws. These Terms grant you no rights in it beyond the license in Section 4.
The Game uses third-party services, including Unity Gaming Services, Unity LevelPlay and its ad networks, and the app store you installed from. Their own terms and privacy policies apply to their services, and we are not responsible for them.
To the fullest extent permitted by law, the Game is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost progress, or lost Virtual Items. Our total liability arising out of or relating to the Game is limited to the greater of the amount you paid us for in-app purchases in the twelve months before the claim, or USD 20. Nothing here limits liability that cannot be limited by law, including for death, personal injury, or fraud.
You may end this agreement at any time by deleting the Game. We may suspend or terminate your license if you breach these Terms, in particular Sections 5 and 10. On termination, your license to the Game and to all Virtual Items ends, with no refund.
We may revise these Terms. The current version is always posted on this page with a "Last updated" date. Material changes are presented for your acceptance the next time you launch the Game, as described in Section 2. If you do not accept them, you must stop using the Game.
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. If you are a consumer resident in the European Union or the United Kingdom, you also keep the protection of the mandatory laws of your country of residence, and may bring proceedings there.
If you obtained the Game from the Apple App Store, the following applies:
If any provision of these Terms is found invalid or unenforceable, the rest remains in force. These Terms and the Privacy Policy are the entire agreement between you and us about the Game. You may not assign your rights under these Terms; we may assign ours to a successor of the Game's business. Our not enforcing a provision is not a waiver of it. We are not liable for delay or failure caused by events beyond our reasonable control, such as war, natural disaster, or failures of networks or app store platforms.
